01 Acceptance of Terms

These Terms of Service ("Terms") govern your use of the Guesthouse Butler mobile application (the "App"), provided by eMviasoft Ltd ("we", "us", or "our"). By downloading, installing, registering an account, or using the App, you agree to be legally bound by these Terms. If you do not agree, you must not use the App.

02 Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the App. By using the App you represent and warrant that:

• You have the legal capacity to enter into a binding contract.
• All information you provide is accurate and complete.
• You will use the App in accordance with these Terms and applicable laws.

03 Description of the Service

Guesthouse Butler is a mobile application designed to help short-term rental property hosts manage their operational tasks, including:

• Reservation management and tracking
• Property and guest information management
• Consumables and stock tracking (towels, linen, supplies)
• Cleaning and maintenance scheduling
• Expense tracking and basic financial reporting
• Local notifications and reminders

The App stores the property, reservation, guest, account, and operational data you enter locally on your device. We do not provide cloud synchronization, online backup, or shared access between devices, unless explicitly stated as a feature of a future update. Limited analytics data may be processed through Firebase Analytics as described in the Privacy Policy.

04 User Accounts

To use the App, you must create a local account on your device. You are responsible for:

• Maintaining the confidentiality of your password.
• All activities conducted through your account.
• Immediately notifying us of any unauthorized use of your account.

Since accounts are stored locally on your device, we cannot recover lost passwords or data on your behalf.

05 Subscription Plans and Pricing

Access to certain features of the App is provided through paid subscription plans. The available plans are:

5.1 Pricing

Prices are listed in Euros (EUR) and exclude Value Added Tax (VAT) where applicable. VAT will be added at the rate required by your country of residence and shown at the time of purchase.

We reserve the right to change subscription prices. Existing subscribers will be notified at least 30 days before any price change takes effect, in accordance with Apple App Store and Google Play Store policies.

5.2 Payment Processing

All subscription payments are processed through:

• Apple App Store (for iOS users)
• Google Play Store (for Android users)

You authorize the relevant app store to charge the payment method associated with your account. We do not collect or store your payment card details.

5.3 Auto-Renewal

Subscriptions automatically renew at the end of each billing period (monthly or annually) unless cancelled at least 24 hours before the end of the current period. The renewal amount will be charged to your account through the relevant app store.

5.4 Cancellation

You may cancel your subscription at any time through your device settings:

• iOS: Settings → [Your Name] → Subscriptions → Guesthouse Butler
• Android: Google Play Store → Menu → Subscriptions → Guesthouse Butler

Cancellation takes effect at the end of the current billing period. You retain access to premium features until that time.

5.5 Refunds

Refunds are subject to the policies of the relevant app store:

EU Right of Withdrawal: Consumers in the European Union have a 14-day right of withdrawal under the EU Consumer Rights Directive. However, by purchasing a subscription and gaining immediate access to the App's premium features, you expressly consent to the immediate performance of the contract and acknowledge that you waive your right of withdrawal once the service has begun, in accordance with Article 16(m) of Directive 2011/83/EU.

5.6 Free Trial for New Users

New users of Guesthouse Butler may start a one-time free trial of 3 (three) days that provides full access to all premium features. The free trial works as follows:

• No payment method or purchase is required to start the free trial, and no payment is taken during the trial period.
• During the trial, the user has full access to all premium features.
• The free trial does not automatically convert into a paid subscription and will not result in any automatic charge.
• At the end of the 3 (three) day period, continued access to premium features requires purchasing a Monthly or Annual subscription.

Example: A user who starts the free trial on May 1, 2026 has full access from May 1 to May 3, 2026. On May 4, 2026 access to premium features is paused, and the user must purchase a Monthly or Annual subscription to continue. If the user subscribes, the standard subscription period and auto-renewal begin from the moment of purchase.

Eligibility: The free trial is offered once per user, regardless of whether the user would later select the monthly or annual plan. Trial availability is determined by the App.

Implementation: The free trial is managed internally within the App and grants temporary access without any app store transaction. If you choose to subscribe during or after the trial, the standard subscription, payment, auto-renewal and cancellation terms set out above apply from the moment of purchase.

06 Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable laws or regulations.
• Reverse engineer, decompile, or attempt to extract the source code of the App.
• Use the App to store or process data that infringes the rights of third parties.
• Use automated systems or scripts to access or use the App.
• Resell, sublicense, or transfer your subscription to another party.
• Attempt to bypass payment requirements or security measures.

07 Your Responsibility for Data

Since data is stored locally on your device:

• You are solely responsible for backing up your data. We strongly recommend using your device's built-in backup features (iCloud, Google Drive, etc.).
• We are not liable for any loss of data caused by device failure, theft, loss, uninstallation, or any other reason.
• You must comply with all applicable data protection laws (including GDPR) when entering guest information into the App.
• You must obtain consent from your guests before storing their personal information.

08 Intellectual Property

The App, including all content, design, code, logos, and trademarks, is the exclusive property of eMviasoft Ltd and is protected by copyright and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal or business use in accordance with these Terms. You are not granted any other rights to the App.

Data you enter into the App remains your property. We make no claim of ownership over your data.

09 Third-Party Services

The App relies on the following third-party services. Your use of these services is subject to their respective terms and privacy policies:

• apple.com/legal/internet-services/itunes
• play.google.com/about/play-terms
• Google Firebase Analytics — used to collect limited analytics data, including a Firebase App Instance ID (not linked by us to the user) and Product Interaction data, solely for analytics purposes.

Further information about the categories, purposes, legal basis, retention, and handling of analytics data is provided in the Privacy Policy, which forms part of these Terms.

10 Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

We do not warrant that:

• The App will be uninterrupted, secure, or error-free.
• The App will meet your specific requirements.
• Any defects will be corrected.
• Calculations or reports generated by the App are suitable for tax, accounting, or legal purposes. You should consult a qualified professional for such matters.

11 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, eMviasoft Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising from your use or inability to use the App.

Our total cumulative liability to you for any claims arising from or related to the App or these Terms shall not exceed the total amount you paid to us for subscriptions in the 12 months preceding the event giving rise to the liability.

Nothing in these Terms excludes or limits liability for: (a) death or personal injury caused by negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be excluded under applicable law.

12 Indemnification

You agree to indemnify and hold eMviasoft Ltd harmless from any claims, damages, or expenses (including legal fees) arising from your use of the App, your violation of these Terms, or your violation of any rights of a third party (including data protection violations regarding guest data).

13 Termination

We may suspend or terminate your access to the App at any time, with or without notice, if you violate these Terms.

You may stop using the App at any time by uninstalling it. Cancellation of your paid subscription does not automatically delete your local data — you must uninstall the App to remove data from your device.

14 Changes to These Terms

We may modify these Terms from time to time. Material changes will be communicated through the App or through the relevant app store. Continued use of the App after changes take effect constitutes acceptance of the modified Terms.

15 Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Bulgaria, without regard to its conflict of law principles. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of Sofia, Bulgaria.

Consumer rights: If you are a consumer residing in the European Union, this choice of law and jurisdiction does not deprive you of the protection afforded by mandatory consumer protection laws of your country of residence. EU consumers may also use the European Online Dispute Resolution platform: ec.europa.eu/consumers/odr

17 Miscellaneous

Severability: If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.

Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and eMviasoft Ltd regarding the App.

No Waiver: Failure to enforce any provision does not waive our right to enforce it later.

Assignment: You may not assign your rights under these Terms. We may assign our rights to any affiliate or successor.
